การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาการรับรู้สิทธิของผู้เสียหายในคดีอาญาของประชาชนในเขตอำเภอเมือง จังหวัดจันทบุรี เพื่อให้ทราบถึงปัญหาในการรับรู้ตลอดจนหาแนวทางในการแก้ไขปัญหาเพื่อให้เกิดการรับรู้สิทธิของผู้เสียหายในคดีอาญาอันจะทำให้เกิดประโยชน์แก่ประชาชนและเกิดประสิทธิภาพต่อมาตรฐานของกระบวนการยุติธรรมทางอาญามากยิ่งขึ้น กลุ่มตัวอย่างที่ใช้ในการวิจัยประกอบด้วยประชาชนที่อาศัยอยู่ในเขตอำเภอเมือง จังหวัดจันทบุรี จำนวน 100 คน เครื่องมือที่ใช้ในการวิจัยเป็นแบบสอบถาม สถิติที่ใช้ในการวิเคราะห์ข้อมูลได้แก่ ค่าร้อยละ โดยใช้โปรแกรมสำเร็จรูปทางสถิติและรวบรวมข้อมูลนำเสนอในรูปของความเรียงในตาราง ผลการวิจัยพบว่า จากการศึกษาการรับรู้สิทธิของผู้เสียหายในคดีอาญาของประชาชนในเขตอำเภอเมือง จังหวัดจันทบุรี โดยภาพรวมพบว่า ระดับการรับรู้ที่มากที่สุดได้แก่ ระดับพอใช้ และ ระดับปานกลาง เท่ากัน ประชาชนส่วนน้อยมีความรู้อยู่ในระดับดี และไม่พบว่ามีประชาชนกลุ่มตัวอย่างมีการรับรู้ในระดับดีมากเลย เมื่อจำแนกการรับรู้สิทธิของผู้เสียหายในคดีอาญาออกเป็น 6 ด้าน พบว่าประชาชนกลุ่มตัวอย่างมีการรับรู้เกี่ยวกับสิทธิของผู้เสียหายในคดีอาญาในภาพรวมทั้ง 6 ด้าน ด้านที่มีผู้รับรู้มากที่สุดได้แก่การฟ้องคดีและการเข้าร่วมเป็นโจทก์ในคดีอาญา ถัดมาเป็นการร้องทุกข์ ความรู้ทั่วไปเกี่ยวกับการเป็นผู้เสียหายในคดีอาญา การถอนฟ้องและการยอมความ การอุทธรณ์ และด้านที่มีการรับรู้น้อยที่สุดได้แก่การฎีกา

The purposes of this research were to study the perception of people in Mueang Chanthaburi District, Chanthaburi Province, regarding to the rights of injured person in criminal case, to acknowledge the problems of perception, along with to search for the means to solve the problems in order to bring about such perception to people and to cause effectiveness to criminal justice system. The research samples consisted of 100 of people who habitat in Mueang Chanthaburi District, Chanthaburi Province. The research instrument used in this study was a questionnaire. The statistics used to analyze the data was percentage by using the statistical package from a computer program. Recommendations were gathered from the descriptive tables. The result of the study were that the overall result of perception of people in Mueang Chanthaburi District, Chanthaburi Province was fair and average. Minority of people was at the good level. The best level was not found. The perception of rights of injured persons in criminal case were classified into 6 aspects, the studies found that the highest level of perception was prosecution of criminal cases and association with the prosecutor. The next was lodging a complaint, general acknowledgement of being injured person in criminal case, withdrawing a criminal charge and compounding a compoundable offence, appealing and the least perception was deeka.
