การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาถึงแนวความคิดและหลักการพื้นฐานที่เกี่ยวข้องกับการอนุรักษ์ช้างป่าโดยชุมชนซึ่งได้แก่ หลักการพัฒนาอย่างยั่งยืน ทฤษฎีสิทธิและเสรีภาพ และภารกิจของรัฐ รวมไปถึงกฎหมายที่เกี่ยวข้องกับการอนุรักษ์ช้างป่าโดยชุมชนซึ่งได้แก่ กฎหมายระหว่างประเทศ และกฎหมายภายในประเทศ เพื่อนำมาทบทวนและวิเคราะห์ปัญหาและเสนอแนะแนวทางแก้ไขปัญหาทางกฎหมายที่เกี่ยวข้องกับการอนุรักษ์ช้างป่าโดยชุมชน ในพื้นที่ตำบลพวา อำเภอแก่งหางแมว จังหวัดจันทบุรี อย่างเหมาะสมสอดคล้องกับแนวทางการอนุรักษ์ จัดการ และใช้ประโยชน์จากทรัพยากรธรรมชาติและสิ่งแวดล้อมในปัจจุบัน จากการศึกษาพบว่า การอนุรักษ์ช้างป่าอย่างยั่งยืนโดยชุมชนในพื้นที่ตำบลพวา อำเภอแก่งหางแมว จังหวัดจันทบุรี มีปัญหาทางกฎหมายคือ ปัญหาเกี่ยวกับความรับผิดในภัยพิบัติที่เกิดจากช้างป่า ปัญหาเกี่ยวกับการจัดทำสวนสัตว์เพื่อแก้ไขปัญหาช้างป่าอย่างยั่งยืน และปัญหาเกี่ยวกับชุมชนในการอนุรักษ์ช้างป่า ซึ่งหากยังไม่มีการแก้ไขเพิ่มเติมย่อมก่อให้เกิดประเด็นปัญหาทำให้ชุมชนในพื้นที่ไม่ได้รับชดใช้ค่าเสียหายที่เป็นธรรมจากรัฐ นอกจากนั้น การแก้ไขปัญหาช้างป่าในพื้นที่โดยการจัดทำสวนสัตว์โดยชุมชนซึ่งจะสนับสนุนต่อการอนุรักษ์อย่างยั่งยืนก็ไม่สามารถกระทำได้เช่นกัน หากปัญหาดังกล่าวข้างต้นยังไม่ได้รับการแก้ไขย่อมส่งผลทำให้เกิดความไม่เป็นธรรมต่อชุมชนผู้ได้รับผลกระทบโดยตรงจากช้างป่า สิทธิและเสรีภาพตามรัฐธรรมนูญก็ไม่ได้รับความคุ้มครอง ดังนั้น ผู้วิจัยขอเสนอแนะให้มีการปรับปรุงแก้ไขพระราชบัญญัติสงวนและคุ้มครองสัตว์ป่า พ.ศ. 2535 โดยบัญญัติให้รัฐต้องรับผิดในค่าสินไหมทดแทนเต็มตามสิทธิหรือความเสียหายที่ได้รับเพื่อให้เกิดความเป็นธรรมจากการที่มีกฎหมายห้ามมิให้ล่าหรือทำร้ายช้างป่า และจัดตั้งกองทุนสัตว์ป่าหรือกองทุนช้างป่าขึ้นเพื่อนำเงินมาชดเชยเยียวยาแก่ผู้ได้รับความเสียหาย และเพื่อให้พนักงานเจ้าหน้าที่มีอำนาจหน้าที่ให้ความช่วยเหลือสนับสนุนการจัดทำสวนสัตว์เพื่อแก้ไขปัญหาช้างป่า อีกทั้งต้องแก้ไขกฎหมายลำดับรองที่เกี่ยวข้องเพื่อให้มีรายละเอียดที่สามารถปฏิบัติการได้อย่างมีประสิทธิภาพและสอดคล้องต่อแนวทางการพัฒนาอย่างยั่งยืนสืบไป

This research aimed to study the basic concepts and principles related to elephant conservation in the community including sustainable development, rights and freedoms and the mission of the state as well as the law related to the wild elephant conservation in the community including international law and domestic law in order to review and analyze problems and propose suitable solutions that were in line with current guidelines of conservation, management and utilization of natural resources and environment for legal issues related to wild elephant conservation by the community in Pawa district Kaeng Hang Maeo district Chantaburi province. The study found that there were legal issues of sustainable wild elephant conservation by community Pawa district Kaeng Hang Maeo district Chantaburi province. Including disaster liability from wild elephants, zoo operation for sustainable wild elephant solution and community problems on wild elephant conservation. If there was on additional problem solving on these issues, the community in this area would not receive fair compensation from the state. Moreover, zoo operation in the community which would support sustainable conservation could not be performed as well. If these issues were not solved, the community that was impacted directly from wild elephant would not receive fairness and protection on lights and freedoms according to the constitution. Therefore, the researcher suggested that the Wildlife Conservation and Protection Act BE 2535 (1992) should be amendment by requiring the state to be liable for the full amount of compensation for damage causing from the law that prohibited wild elephant hunting or hurting. There should be wild animal fund or wild elephant fund to raise money for damage compensation and remedy and for the support from the authorized officers on operating the zoo to solve wild elephant problems. Moreover, related secondary laws should be amended for effective practice and consistency towards further sustainable development.
