ปัญหาของกระบวนการยุติธรรมไทยในปัจจุบันที่มีสาเหตุหลักมาจากความเป็นกลไกระบบ ราชการขนาดใหญ่และใช้ทรัพยากรมาก ประกอบกับกระบวนการยุติธรรมในหลายขั้นตอนต้องใช้ เวลานาน ส่งผลให้ปริมาณคดีที่เข้าสู่กระบวนการพิจารณาของศาลมีจานวนมากขึ้น ก่อให้เกิดปัญหา “คดีล้นศาล คนล้นคุก” รวมถึงปัญหาที่ประชาชนยังไม่มีช่องทางในการเข้ามามีส่วนร่วมในระบบงานยุติธรรมอย่างเป็นรูปธรรม ดังนั้น จึงมีความจาเป็นที่จะต้องเสริมประสิทธิภาพของกระบวนการยุติธรรมกระแสหลักด้วยกระบวนการยุติธรรมทางเลือก โดยการสร้างกลไกการมีส่วนร่วมของประชาชนในระบบงานยุติธรรมในระดับตาบล หมู่บ้าน และชุมชน สาหรับภาครัฐให้เป็นหน่วยงานสนับสนุนพัฒนาและส่งเสริมการดาเนินงานของภาคประชาชนในรูปแบบของศูนย์ยุติธรรมชุมชนอาสาสมัครยุติธรรมชุมชนและเครือข่ายยุติธรรมชุมชนเพื่อการเสริมสร้างความเป็นธรรมทางสังคม ( Social Justice) อันจะนำไปสู่การลดปริมาณคดีขึ้นสู่ศาลและลดปริมาณผู้ต้องขังที่มีจานวนมากเกินไปในปัจจุบัน ตลอดจนการเสริมสร้างชุมชนให้เข้มแข็งมีศักยภาพมีความปลอดภัย และเป็นสังคมที่มีความสมานฉันท์หรือความสามัคคีปรองดองกันมากยิ่งขึ้นต่อไป จากหลักการอันเป็นสาระสาคัญดังกล่าวจึงให้มีกฎหมายว่าด้วยยุติธรรมชุมชน เนื่องจากการ มีส่วนร่วมของชุมชนในงานยุติธรรมตามแนวความคิดยุติธรรมชุมชนในปัจจุบันยังไม่มีกรอบแนว ทางการดาเนินงานที่ชัดเจนและยังไม่มีกฎหมายรองรับ การปฏิบัติงานของหน่วยงานหรือองค์กรที่เกี่ยวข้อง เป็นผลให้การดาเนินงานดังกล่าวยังไม่สามารถบรรลุผลตามวัตถุประสงค์ จึงสมควร กาหนดให้มีกฎหมายเกี่ยวกับการส่งเสริมการมีส่วนร่วมของประชาชนในด้านงานยุติธรรมระดับชุมชนเพื่อเป็นเครื่องมือในการส่งเสริมการมีส่วนร่วมของประชาชนในงานยุติธรรมชุมชนและรองรับการปฏิบัติงานของหน่วยงานหรือองค์กรที่เกี่ยวข้องจึงจาเป็นต้องมีกฎหมายมารองรับดังนั้น จึงมีความจาเป็นของบุคลากรในทางการศึกษารายวิชานิติศาสตร์ที่ต้องใช้รูปแบบการ เรียนการสอนโดยเน้นนักศึกษาเป็นศูนย์กลาง และเปิดโอกาสให้นักศึกษาได้มีโอกาสลงไปใกล้ชิดกับสังคม และท้องถิ่นเพื่อรับทราบปัญหาและร่วมแก้ไขปัญหาของคนในสังคม ในท้องถิ่น เพื่อเป็นพื้นฐานในการถ่ายทอดความรู้อันช่วยสนับสนุนกระบวนการยุติธรรมชุมชนให้เข้มแข็งขึ้นได้

The problem of Thai justice system today is mainly due to the large bureaucratic mechanisms and the use of resources a lot. The process of justice in many stages takes a long time. As a result, the number of lawsuits enters into the court process has increased which leads to the problem of "division of cases and offenders " as well as the lack of channels for public participation in the justice system. Therefore it is necessary to enhance the effectiveness of the mainstream justice system.The alternative justice system by creating a mechanism for public participation in the justice system at the sub-district, village and community level,in which the government needs to support, develop and promote the operation of the public sectors in the form of Community Justice Centers, Community Justice Volunteers and Community Justice Network in order to promote social justice. Which will lead to reduction of the number of cases enters into the court and the number of the prisoners that have too much currently,as well as lead to strengthening community that has potential and safety and harmonious or reconciled society further more. Based upon these principle, that must be a law on community justice due to currently there are no clear guidelines for public participation in justice according to the community justice concept,and there and no laws to support the working of related departments or organizations. As a result, the objectives of the mentioned operation cannot be achieved. Therefore,it is necessary to stipulate the laws thatencourage public participation in justice community level to be a tool for the promotion of public participation in community justice and support of the operation of related departments or organizations. Hence,it is important for the academic personnel of law subject to use the learning and teaching process that focus mainly on the student center and provide an opportunity for the students to work with the community and local in order to acknowledge problems and find solution together with people in the society and local to be an element for knowledge transfer which will promote stronger community justice process.
